Terms and Conditions
Park Tower Hotel Co., Ltd. "Park Hyatt Tokyo" (hereafter, the "Hotel"), in accordance with the terms and conditions of this online shop (hereafter, the "Terms"), will sell products on the Hotel’s website (hereafter, the "Product") by the online order (hereafter, the "Service"). Any person who wishes to use the Service (hereafter, the "User") is asked to carefully read and accept the Terms beforehand.
Article 1: Scope of Application
The Terms applies to the sale and purchase of products using the Service, with the Hotel as seller and the User as purchaser. Notwithstanding foregoing, where any special terms and conditions are stipulated on the website for specific products, such special terms and conditions shall prevail over the Terms and apply to such specific products.
Article 2: Order Placement Method
1. In order to place a purchase order (hereafter, the "Order") for the Product, the User will be required to enter the pertinent order information on the Hotel’s designated webpage, then transmit it over the Internet to the Hotel (hereafter, "Online Order"). Orders may be placed 24 hours a day.
2. During the process of the Online Order, the User will find an order webpage on which the User will be required to enter information, including the delivery address, the User’s name, telephone number, credit card number (hereafter, "Order Form"), and an confirmation webpage on which the User will be able to confirm the information the User entered on the Order Form and the content of the Order (hereafter, "Confirmation Page"). The User is asked to enter the accurate information on the Order Form and confirm the information entered and Order content on the Confirmation Page because the process after the Order will be based on the information transmitted to the Hotel. Further more, the User is asked to acknowledge that the Hotel is not responsible for any request, claim, demand whatsoever made by the User after the Contract being effective pursuant to the Article 3 in relation to, or arising out of any errors in the Order transmitted to the Hotel by the Online Order except for errors arising out of reasons attributable to the Hotel.
Article 3: Sale and Purchase Contract
The sale and purchase contract between the User and the Hotel (hereafter, the "Contract") becomes effective when the User receives the Order Reception Completion E-mail as stipulated in the Article 4.
Article 4: Order Confirmation E-mail
1. After receiving the Online Order, the Hotel automatically sends an order receipt e-mail (hereafter, "Order Receipt E-mail"). The Order Receipt E-mail is sent only for the purpose of the User’s confirmation that the Hotel has received the Order; therefore, it shall be construed as neither an acceptance of the Hotel to the Order nor the formation of the Contract.
2. After an Order Receipt E-mail is sent, the Hotel will check the inventory for the Product and the total amount of the Order are checked, then will send an order confirmation e-mail (hereafter, "Order Confirmation E-mail") to the User.
3. If the User does not receive an Order Confirmation E-mail within 36 hours after placing an Online Order, the Order may not have been received by the Hotel due to some problems, such as communication failure. In this case, the Hotel would like to ask the User to re-submit the Order Form by the Online Order again. For avoiding duplicate Orders, the User is asked to enter the word "Resending" in the comment box.
4. The Hotel may contact the User by telephone or e-mail to inform or confirm the Order status if the Product cannot be delivered by the requested date or cannot be delivered for a considerable period of time because of long term stockout of the Product, or any errors are found in the Order Form.
Article 5: Changes and Cancellations
The User may change or cancel the placed Order by calling the Park Hyatt Tokyo Online Shop by the time the Contract is being effective pursuant to the Article 3. After the Contract being effective, the Order cannot be changed or cancelled except for as stipulated in the Article 10.
Article 6: Orders that Require a Guardian’s Permission
The User under 20 years of age shall place the Order with consent of its parent or guardian. Under no circumstances, even with the consent of a parent or guardian, a User under 20 years of age may not place an Order or purchase alcohol Product and certain other Product.
Article 7: Payment Methods and Payment Due
The User may choose one of the following payment methods:
(1) Credit card
a. Payment can be made only by the person whose name appears on the card.
b. The payment shall be made in a single installment.
c. The cardholder (User) will be required to enter the credit card number, expiration date, type of card, cardholder’s name, and whether the cardholder is an adult or a minor on the Order Form.
d. The cards accepted are VISA, MASTERCARD, DINERS, AMERICAN EXPRESS, and JCB.
e. The terms and conditions of each credit card company will apply to the payment by the User.
(2) Payment on delivery
a. Payment of the Product can be made on delivery to the deliverer. The User can make such payment only by cash.
b. When the User chooses the payment on delivery, the User shall pay the following additional following handling charges, which will be charged in accordance with the Product price (excluding shipping cost and other handling charges).

c. Payment on delivery is not available when the delivery address differs from the User’s address.
d. Payment on delivery may not be available in certain locations (such as remote islands).
(3) Bank Transfer
a. After receiving the Order Confirmation E-mail, the User is asked to transfer the total amount of the product payment, shipping cost and other handling charges to the bank account given below:

b. Payment by the bank transfer shall be made by wire transfer. The bank transfer fee shall be paid at the User’s expense.
c. With the bank transfer method, the Hotel will send the Product after confirming receipt of payment, which usually takes about three business days (subject to change). Therefore, if the User wishes immediate delivery, the Hotel recommends another payment method.
Article 8: Delivery
1. Product is delivered by Sagawa Kyubin delivery service. (Certain Product may be delivered by other services).
2. Product delivery is limited within Japan.
3. Generally, Products ordered in a single Order are generally delivered in one shipment. However, some Products may be delivered in more than one shipment.
4. Shipping charge, which is charged separately from Product price, is 700 yen per delivery, including tax. For "Premium Frozen Desserts", the shipping charge is 1,000 yen per delivery, including tax. However, for Orders that include a large number of items, shipping charge may vary. In such a case, the Hotel will contact the User by telephone or in the Order Reception Completion E-mail to inform the User of applicable shipping charge.
5. Product which requires refrigeration will be shipped by Cool-bin.
6. If the Product is in stock, it will usually be delivered from three days to one week from the time of the Contract being effective. However, in case that delivery time is expected to be delayed due to lack of stock, region of delivery or some other reason, the Hotel will contact the User by telephone or e-mail.
7. If the User has special requests regarding delivery date or time, please inform us of your date or time preferences for a date that is at least 3 days after the date of the Order.
8. Due to lack of stock of the Product or any other reasons, the delivery date shall be subject to change from the designated date by the User. In such cases, notwithstanding Article 8.6, and 8.7, the Hotel will not be liable for any losses or damages arising out of such change or delay.
Article 9: Transfer of Possession Rights
1. Possession Rights transfer from the Hotel to the User at the time the User receives the ordered Product.
2. Notwithstanding Article 9.1, for Users who choose to pay by credit card, the membership contract of the credit card company may stipulate that the credit card company reserves possession rights to the ordered Product. Please check the details of your contract with your credit card company.
Article 10: Returns and Exchanges
1. If the Product delivered is different from the Product the User ordered, or the Product is defective, or the User does not like the Product, the User may return such Product, subject to following conditions, by calling or sending an e-mail to the Hotel within seven days after receipt of the Product However, the Product can not be exchanged for any different Product.
2. If the User wishes to return the Product, the User shall inform the Hotel by telephone or e-mail with the reason for the return within seven days after receipt of the Product.
3. When returning refrigerated Product, the User is asked to return the Product by refrigerated shipping.
4. If the User wishes to return the Product because the Product is defective, is not the Product the User ordered, or is spoiled or damaged, or has any problems, which are attributable to the Hotel, the Hotel will bear the original shipping cost, payment on delivery charges, refrigerated shipping cost, and/or return shipping cost.
5. If the User wishes to return the Product because of the User’s reasons, such as the User does not like the Product, the User shall bear the original shipping cost, payment on delivery charges, refrigerated shipping cost, return shipping cost and bank transfer charges for product payment return.
6. Notwithstanding foregoing, the User may not return the Product in following circumstances:
a. When the User contacts the Hotel on or after the eighth day from the delivery.
b. When the product tags, price tags, labels, etc. have been removed from the Product.
c. When the Product has been used or opened.
d. When the Product is delivered by refrigerated shipping (unless the Hotel is responsible for problems with the Product, such as defective Product or wrong Product has been shipped).
e. When the Product was purchased at the hotel store.
Article 11: Refund for Returned Product
1. If the payment was made by credit card, depending on the credit card company’s monthly closing date, payment may be refunded by one of the following methods:
a. Before the monthly closing date: the charge for the credit card payment is cancelled.
b. After the monthly closing date: Payment is returned to the User by bank transfer or cash is sent by registered mail. The User’s monthly credit card company statement will include the order amount reimbursed to the User.
2. When the payment method is payment on delivery or bank transfer, the payment amount is returned to the User by bank transfer or cash sent by registered mail.
Article 12: Warranty
Warranty in relation to the Product will be provided by the maker or manufacturer of the Product pursuant to the terms and conditions as set forth in the warranty certificate or other document attached to the Product.
Article 13: Liability
The Hotel is not liable for any losses, damages, costs, or expenses incurred by the User or any third party resulting, whether directly or indirectly, from the use of the Product unless otherwise stipulated in the Terms or such damages are attributable to the Hotel.
Article 14: Personal Information
The Hotel may use information about the User that distinguishes and identifies the User (hereafter, "Personal Information") and transaction information (including the User’s purchasing history information) obtained through the Service for the purpose of , not only providing the Service, but also providing the User with information of the Hotel events, products information, marketing surveys (including questionnaires), and other information related to the Hotel. Unless otherwise permitted by law, the Hotel will not disclose or furnish the Personal Information or transaction information to third parties without prior consent of the User. Article 15: Miscellaneous
1. Actual product colors may differ slightly from their appearance on the screen.
2. When User data is lost due to the malfunction of equipment for the Service or malfunction of transmission circuits, the Hotel may unconditionally and immediately terminate the Contract without any notice to the User.
3. System malfunctions may sometimes prevent or delay e-mails from Users to the Hotel. The Hotel is not liable for any losses, damages, cost, or expenses incurred by the User arising out of, whether directly or indirectly, such non-delivery or delay in delivery of the User’s e-mail.
4. The Purchasing Terms may be changed without notice to the User. The User is responsible for confirming such changes if they are available on the Hotel’s website. However, if Product is ordered before such change is made in the Terms, the former terms and conditions applies.
5. The governing law of the Terms is the law of Japan. The User and the Hotel agree that the Tokyo Summary Court or the Tokyo District Court shall have exclusive jurisdiction and that any lawsuit arising between the User and the Hotel related to the Service shall be submitted to one of those courts, as the case may be.
